Terms of Service

1. Agreement to Terms

By accessing or using TrackLTL ("Service"), operated by TrackLTL ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including merchants, their employees, and end-users who access branded tracking pages.

2. Description of Service

TrackLTL provides a white-label LTL (Less-Than-Truckload) freight tracking platform that allows merchants to offer branded shipment tracking pages to their customers. The Service includes:

  • Branded tracking page generation with custom logo, colors, and domain
  • Real-time tracking data from supported LTL carriers
  • Shopify integration for order-to-tracking linkage
  • Dashboard for managing brand settings and carrier connections
  • API access for programmatic tracking lookups

3. Account Registration

To use the Service, you must create an account by providing your company name, email address, and a secure password. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate, current, and complete registration information
  • Notifying us immediately of any unauthorized access to your account

4. Subscription and Billing

Pricing: The Service is offered at $499.95 per month ("Subscription Fee"). Pricing is subject to change with 30 days' advance notice.

Free Trial: New accounts receive a 14-day free trial. No credit card is required to start the trial. At the end of the trial period, you must add a valid payment method to continue using the Service.

Billing Cycle: Subscriptions are billed monthly on the anniversary of your subscription start date. Payments are processed through Stripe.

Failed Payments: If a payment fails, we will attempt to process it again at 1, 3, and 7 days after the initial failure. After three failed attempts, your account may be suspended.

Refunds: We offer a pro-rated refund for cancellations within the first 30 days of a paid subscription. After 30 days, no refunds will be issued for partial billing periods.

5. Cancellation

You may cancel your subscription at any time through the Stripe Customer Portal or by contacting support. Upon cancellation:

  • Your account will remain active until the end of the current billing period
  • Your branded tracking pages will be deactivated at the end of the billing period
  • Your data will be retained for 30 days after cancellation, after which it will be permanently deleted
  • You may request an export of your data before deletion

6. Acceptable Use

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. See our Acceptable Use Policy for specific restrictions.

7. Carrier Data

Tracking data displayed through the Service is sourced from third-party LTL freight carriers. We do not guarantee the accuracy, completeness, or timeliness of carrier-provided data. TrackLTL is not responsible for:

  • Errors, delays, or inaccuracies in carrier tracking data
  • Carrier API downtime or service interruptions
  • Discrepancies between tracking data and actual shipment status

8. Carrier Credentials

To use the Service, you may provide API credentials for your carrier accounts. You represent that you are authorized to use these credentials and that your use complies with each carrier's terms of service. We encrypt carrier credentials at rest and limit access to authorized systems only.

9. Intellectual Property

TrackLTL and its original content, features, and functionality are owned by TrackLTL and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your brand assets (logo, company name, colors) that you upload to the Service.

10. Limitation of Liability

To the maximum extent permitted by law, TrackLTL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TrackLTL, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our reasonable control.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or through the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration.
